Temply is a digital service offered by the provider. By accessing or using the service, you agree to these Terms. We may update, modify, or discontinue features at any time without prior notice. We do not guarantee uninterrupted availability, specific results, or fitness for a particular purpose.
User responsibilities
When using Temply, you agree to:
- Not use the service for any illegal, fraudulent, or abusive activity.
- Not infringe any third-party rights, including intellectual property, privacy, or publicity rights.
- Not interfere with, disrupt, or attempt to gain unauthorized access to the service or its infrastructure.
- Comply with all applicable laws and regulations.
We reserve the right to restrict or terminate access in cases of misuse.
Liability
Liability is limited to the extent permitted by German law. We are liable without limitation for damages caused by intent or gross negligence, for injury to life, body, or health, and under the German Product Liability Act (ProdHaftG). For damages caused by simple negligence, we are only liable in case of breach of a material contractual obligation (cardinal duty), and such liability is limited to the foreseeable, typical damage. Any further liability is excluded. This limitation also applies to our legal representatives and vicarious agents.
Termination
You may stop using the service at any time without notice. We may suspend or terminate your access to the service at our discretion, in particular in case of a breach of these Terms or misuse of the service.
Governing law & jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which the user has their habitual residence remain unaffected.
The place of jurisdiction for all disputes arising from or in connection with these Terms is Herford, Germany, to the extent permitted by law.
Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the intended purpose.
